In many cases, individuals with Polish ancestry cannot confirm or restore citizenship through standard procedures—such as acquisition by operation of law, confirmation, recognition, or restoration—due to missing documentation (often destroyed during wartime), loss of citizenship in the family line, or prior renunciation.
When these avenues are unavailable, granting of Polish citizenship by the President of the Republic of Poland may offer a viable alternative, provided the applicant’s circumstances and family history present compelling grounds.
Under the Act of April 2, 2009, on Polish Citizenship, the President holds discretionary authority to grant citizenship to any foreigner upon request (Art. 18). This prerogative is constitutional and largely unbound by fixed criteria, distinguishing it from other acquisition methods.
Application Submission
Applicants must file through the appropriate authority based on residence:
- Residents of Poland: submit to the voivode competent for their place of residence.
- Residents abroad: submit through the Polish consul competent for their place of residence.
Direct submissions to the Chancellery of the President are returned without consideration.
Key Formal Requirements
A current Polish birth certificate and (if applicable) marriage certificate must accompany the application. If foreign civil status records have not been transcribed into Polish registers, applicants must first complete the transcription procedure.
The application requires a well-supported justification demonstrating substantial grounds for granting citizenship, backed by relevant documentation.
Discretionary Nature of the Procedure
Unlike standard administrative proceedings, the presidential grant process is exempt from most provisions of the Code of Administrative Procedure (except those on service of documents). The President’s decision:
- Is fully discretionary,
- Requires no justification,
- Is final and not subject to appeal.
Processing times vary and carry no statutory deadline, often extending over months or years.
